Terms of Service — Brobbey Afro Percussion

These Terms of Service (“Terms”) govern your use of the Brobbey Afro Percussion mobile application (the “App”), published by TapTap Performance LLC (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App and what it does
Brobbey Afro Percussion is a traditional Ghanaian and West-African percussion ensemble instrument. It features 16 percussion voices, supports polyrhythm and polymeter (independent per-voice loop lengths), and includes the Rhythmic Intelligence Engine (RIE) — a self-generating ensemble and conductor mode with an educational perspective on the traditions it draws from. The App is a creative and educational tool for making music, not a substitute for professional instruction.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own purposes, subject to these Terms and the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, resell, or redistribute the App except as permitted by law.
4. User content
Percussion patterns, sequence configurations, polyrhythm settings, and other data you create are your content. You retain ownership of your content. All user content is stored locally on your device. We do not claim ownership of your content and will not use it for advertising or sell it to third parties.
5. Subscriptions and purchases
Brobbey Afro Percussion may offer features through auto-renewing subscriptions managed by Apple StoreKit:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- You can manage or cancel subscriptions in your device Settings → [your name] → Subscriptions.
Prices are shown in the App and may vary by region and over time. Purchases are processed by Apple; refunds are handled by Apple under its policies, not by us.
6. Data storage
Your data is stored locally on your device. We do not operate servers that store your personal data or creative content. See our Privacy Policy for full details on data handling.
7. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED. THE EDUCATIONAL CONTENT PROVIDED THROUGH THE RIE AND ELSEWHERE IN THE APP IS FOR INFORMATIONAL AND CREATIVE PURPOSES AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MUSIC INSTRUCTION.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $25. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
9. Changes
We may update the App and these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use after changes means you accept the revised Terms.
10. Termination
We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time. Sections that by their nature should survive (disclaimers, limitations, etc.) will survive termination.
11. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules.
